Electronic Fund Transfer Act Disclosures

Please note, capitalized terms used but not defined herein shall have the meaning ascribed to them in the Zero Hash & Zero Hash Liquidity Services User Agreement (“User Agreement”), the acceptance of which is required for you to open an account with Zero Hash.

Where applicable, Zero Hash may allow you to fund or receive funds for your Cryptocurrency Transactions via ACH transfers (“Electronic Transfers”), provided that such Electronic Transfers are supported by the Platform through which you’ve opened your Zero Hash Account. To engage in Electronic Transfers, you must first agree to the Authorization Agreement presented to you through the Platform and provide Zero Hash the information requested in the Authorization Agreement and any additional information that may be requested by Zero Hash. Unless expressly stated otherwise by Zero Hash in writing, ACH-funded transfers are the only permitted Electronic Transfers that may be made within your Account.

If you discover an Electronic Transfer that you did not authorize (“Unauthorized Transfer”), then you must notify Zero Hash of such Unauthorized Transfer in by notifying Zero Hash in writing by emailing [email protected], calling (855) 744-7333 (provided, however, that Zero Hash may require you to separately email Zero Hash of your complaint as well), or delivering written notice in person to 327 N. Aberdeen St. Chicago, Illinois 60607, USA. The Zero Hash phone number and support email are monitored at all times of the day on each day of the year. The Zero Hash office at the address above is open from 9 AM to 5 PM Central Standard Time, Monday through Friday (except on U.S. bank holidays). If you notify Zero Hash within two (2) business days of learning of an Unauthorized Transfer (“2-Day Period”) caused by the loss or theft of an access device (i.e., the means by which you may initiate an Electronic Transfer in your Account, such as your Login Credentials (defined below)), then your liability for an Unauthorized Transfer will not exceed the lesser of: (i) $50, or (ii) the amount of Unauthorized Transfers that occurred before you provided notice to Zero Hash. If you fail to notify Zero Hash within the 2-Day Period, then your liability for such an Unauthorized Transfer will not exceed the lesser of: (a) $500, (b) $50 (or the amount of Unauthorized Transfers that occurred within the 2-Day Period, whichever is less), or (c) the amount of Unauthorized Transfers that occurred after the close of the 2-Day Period and before notice to Zero Hash, provided that Zero Hash establishes that these Unauthorized Transfers would not have occurred had you notified Zero Hash within the 2-Day Period. In addition to the foregoing, you must provide notice to Zero Hash of any Unauthorized Transfers caused by the loss or theft of an access device within sixty (60) days of receiving a periodic statement (“60-Day Period”) (whether from Business or Zero Hash) on which an Unauthorized Transfer appears. If you fail to provide such notice, you may have unlimited liability for any Unauthorized Transfers made after the 60-Day Period if Zero Hash determines that such Unauthorized Transfers would not have occurred had you notified Zero Hash within the 60-Day Period. For Unauthorized Transfers not caused by the loss or theft of an access device, then you must notify Zero Hash within the 60-Day period in order to avoid liability for subsequent Unauthorized Transfers. However, if you fail to notify Zero Hash within the 60-Day Period, then you may have unlimited liability for all such Unauthorized Transfers. If your delay in notifying Zero Hash was due to extenuating circumstances (as determined by Zero Hash in its sole discretion), then Zero Hash will extend the times specified above to a reasonable period.

If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance:

  1. If, through no fault of ours, you do not have enough money in your account to make the transfer.
  2. If the transfer would go over the credit limit on your overdraft line.
  3. If the Zero Hash platform was not working properly and you knew about the breakdown when you started the transfer.
  4. If circumstances beyond our control (such as fire or flood) prevent the transfer, despite reasonable precautions that we have taken.
  5. There may be other exceptions stated in the User Agreement.

Any limitations on the frequency and fiat currency of your Electronic Transfers, as well as fees for initiating Electronic Transfers, will be subject to the User Agreement. You will also receive Electronic Transfer receipts and periodic statements for all Electronic Transfers in accordance with the User Agreement. Zero Hash is not responsible or liable for any pre-authorized orders, including any Electronic Transfers resulting therefrom.
