RETURN/CANCELLATION/REFUND POLICY The State of Alabama provides the following guidance as it relates to refund policy requirements: If a new consumer has been fraudulently induced to engage in a cryptocurrency kiosk If a new consumer has been fraudulently induced to engage in a cryptocurrency kiosk transaction and has completed the requirements (provided below), the operator shall issue a full refund for the fraudulently induced transaction, as well as all fees incurred through the transaction. If an existing consumer has been fraudulently induced to engage in a cryptocurrency kiosk transaction and has completed the requirements of subdivision (2), the operator shall issue a refund for one-half of the value of the transaction, including all fees incurred through the transaction. The consumer shall complete all of the following to receive the refund pursuant to subdivision: Contact the operator not more than 60 calendar days after the cryptocurrency kiosk transaction. Contact a law enforcement agency, as well as the commission, not more than 60 calendar days after the transaction. File a report with a law enforcement agency or the commission regarding the fraudulently induced transaction. A consumer who has been determined to be a victim of fraud is eligible to receive a refund regardless of whether an operator provided the disclosures prescribed in AL H.B.303. An operator shall maintain a report of all refund requests made. The operator shall provide to the commission the name and contact information of the consumer who made the request, as well as the information on the receipt, upon request of the commission.
LIABILITY FOR NON-DELIVERY OR DELAYED DELIVERY zerohash llc’s or zerohash liquidity services llc’s aggregate liability, including for non-delivery or delayed delivery, is limited to losses resulting solely from the gross negligence, intentional misconduct or fraud of zerohash or zerohash liquidity services, their affiliates or any of their officers, directors, managers, partners, employees or independent agents or contractors, as determined by a court of competent jurisdiction or arbitration panel in accordance with the terms of the zerohash and zerohash liquidity services User Agreement.
